These terms and conditions govern your use of the site and the purchase of goods and services from our site.  You will also find details on your privacy and your security on other pages, so please take time to carefully read these terms and conditions before using the site.  In this text, all references to “I”, “my”, “us” or “we” means Frances Garriock.

Acceptance of Terms & Conditions

The client must ensure they have read and fully understood the terms set out by Frances Garriock.

By placing an order you are agreeing to the Terms and Conditions expressed. All orders are subject to availability and confirmation of the order price. Dispatch times may vary and any estimates on delivery times are subject to any delays resulting from postal delays, weather or a problem with delivery companies for which we cannot be held responsible. Please see ‘Delivery Information’ for further information.

When placing an order with us it is your responsibility to ensure that all the details you provide are accurate and truthful, that you are the authorised user of the credit card or payment method and that there are sufficient funds with which to make payment for any order placed.

A contract is formed between you and Frances Garriock at the point where you receive confirmation of the order and payment has been made (commercial clients may have alternative terms agreed).

The client should contact Frances Garriock in order to clarify anything that is unclear.

Project Acceptance and Commencement

No creative or development work will commence until Frances Garriock has received payment in full by placing an order on the website or by alternative agreed arrangement in writing.

Price/Quotes/Estimates for Individual Pieces

The costs provided when quoting are guide prices based upon what I anticipate to be the creative time and materials to implement the client’s specific requirements (based on previous experience and on typical processes). I require the client’s co-operation in respect of ascertaining the exact requirements of the project, and guidance during the process to ensure the client’s requirements are fulfilled to the highest standard. Charges are unlikely to deviate from those quoted unless the client’s requirements change significantly.

Quotes for individual or customised pieces are valid for 2 months from the date given.

Indemnity

The Client shall indemnify Frances Garriock against any loss or damage which results from the Client’s breach of this agreement or failure to abide by any of its terms.

Payment 

Prices on the website are stated in British Pounds Sterling £GBP and do not include VAT as Frances Garriock is not a VAT registered company.

Unless otherwise agreed in writing, all payments are due immediately on placing an order on the website. Payment will be taken through a secure payment gateway on the website.  We use Stripe and PayPal to process our online transactions.

For any individual pieces commissioned or commercial contracts a 50% deposit is requested, following which the remainder will be invoiced.  No items will be dispatched until payment is made in full.  Payments may be made by PayPal, online transfer, cash, or (for overseas clients), Pound Sterling International Money Order or previously agreed electronic funds transfer.

Copyrights and Trademarks

The material contained in this website is the property of Frances Garriock and may not be copied, shared or distributed without the express permission of Frances Garriock.  This includes all designs, photographs, graphics and any other material displayed in the website.

Frances Garriock will never knowingly infringe any copyright or trademark and will deliver, to the best of her knowledge, creative solutions that are original and unique to Frances Garriock. Unless otherwise agreed in writing, it is the responsibility of the client to ensure that no copyright or trademark has been infringed and to make an application for copyright or trademark with the UK Intellectual Property Office if required. The client agrees to fully indemnify and hold Frances Garriock free from liability in any claims resulting from the client not having obtained the necessary legal permissions.

Confidentiality

Frances Garriock will treat all communications with the client as strictly confidential, both during and after the project development period, unless permission is given by the client.

Disclaimer in relation to Third Parties

Frances Garriock will not be held liable for delays caused by any third party issues or circumstances outwith her control.

Cancellations

If you have made an error whilst ordering or wish to cancel your order, please get in touch immediately by telephone or email.

Please note that orders can only be cancelled before the items are despatched. If your items have been despatched, we are unable to cancel your order, so you will need to refer to our Refund Policy page.

For customised pieces the work undertaken up to the date the cancellation notification is received will be charged for (less the deposit already paid).

Data Protection

We shall process your data in accordance with the Data Protection Act 1998 and the General Date Protection Regulation (GDPR).  See Cookie and Privacy Policy.

General

Any dispute or claim associated with these Terms and Conditions shall be subject to the exclusive jurisdiction of the Scottish courts.

These Terms and Conditions of business supersede any previous versions. Frances Garriock reserves the right to change or modify these terms at any stage. By agreeing to these terms, your statutory rights are not affected.

When using our website, we may provide links to other, third party websites. These links are for your information only and do not constitute any endorsement of any third party products, services or information. We have no responsibility for the content of such websites and accept no liability for any losses that may be incurred as a result of any linking to the same.

Feedback and Complaints

We welcome any feedback from our customers as this allows us to improve our service.  Complaints are taken seriously and in confidence and if for any reason you are not entirely satisfied, please do not hesitate to get in touch and we will aim to resolve it immediately.

If you prefer to arrange your own shipping, please be aware that Frances Garriock accepts no responsibility once the goods have left our workshop in Orkney. We would advise using a reputable company and always include their full insurance option to cover the full value of your order.
